Important Exceptions

Discovery Rule

Some states allow the deadline to start when you discover the problem, not when it occurred.

Tolling

The deadline may be paused ("tolled") if:

  • Defendant is out of state
  • Defendant is a minor
  • You're in active negotiations
  • Court orders a stay

Contractual Limitations

Some contracts shorten the statute of limitations. Check your contract terms.
